On April 28, 2014 (79 FR 23306), the Federal Motor Carrier Safety Administration (FMCSA) published a Notice of Proposed Rulemaking (NPRM) in the federal register to allow the use of electronic records and signatures to satisfy FMCSA’s regulatory requirements. The amendments would permit the use of electronic methods to sign, certify, generate, exchange or maintain records so long as the documents accurately reflect the information in the record and can be used for their intended purpose. This proposed rule would apply only to those documents that FMCSA’s regulations obligate entities or individuals to retain; it would not apply to forms or other documents that must be submitted directly to FMCSA. It would also update references to outdated recordkeeping and reporting methods throughout Chapter III of Subtitle B of Title 49, Code of Federal Regulations (49 CFR Parts 300–399) to make them technologically neutral. You may submit comments on or before June 27, 2014. Comments received after this date will be considered to the extent practicable.
