On August 5, 2016, the Environmental Protection Agency (EPA) published a direct final ruling (81 FR 51802) and a proposed ruling (81 FR 51838) in the federal register concerning Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals From Electric Utilities; Extension of Compliance Deadlines for Certain Inactive Surface Impoundments; Response to Partial Vacatur. Both rulings extend for certain inactive coal combustion residuals (CCR) surface impoundments the compliance deadlines established by the regulations for the disposal of CCR under subtitle D of the Resource Conservation and Recovery Act (RCRA). These revisions are taken in response to a partial vacatur ordered by the United States Court of Appeals for the District of Columbia Circuit (D.C. Circuit) on June 14, 2016. The direct final rule is effective on October 4, 2016 without further notice, unless EPA receives adverse comment by August 22, 2016 on either the proposed or the final ruling. If the EPA receives adverse comment, they will publish a timely withdrawal notice in the Federal Register informing the public that the rule will not take effect.
