On January 11, 2021 (86 FR 1745), the Department of Transportation (DOT or the Department) published a final rule in the federal register providing the 2020 inflation adjustment to civil penalty amounts that may be imposed for Office of the Secretary (OST) and DOT’s operating administration’s violations of certain DOT regulations in accordance with the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. In additional, this final rule makes conforming revisions to Federal Motor Carrier Safety Administration (FMCSA) regulations to reflect inflationary adjustments to the statutorily-mandated civil penalties for violations of Federal law. The Department emphasizes that this rule adjusts penalties prospectively, and therefore the penalty adjustments made by this rule will apply only to violations that take place after this rule becomes effective. This final rule is effective on January 11, 2021.
